AEGEANVIP IS NOT LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES, NEGLIGENCE OR MISCONDUCT OF ANY SUCH SUPPLIERS OR FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING THEREFROM OR OTHERWISE ARISING FROM ANY BOOKING OR USE OF A PRODUCT. AEGEANVIP HAVE NO LIABILITY AND WILL MAKE NO REFUND IN THE EVENT OF ANY DELAY, CANCELLATION, OVERBOOKING, STRIKE, FORCE MAJEURE OR OTHER CAUSES BEYOND THEIR DIRECT CONTROL, AND THEY HAVE NO RESPONSIBILITY FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, RE-ROUTING OR ACTS OF ANY GOVERNMENT OR AUTHORITY.

If AEGEANVIP is found liable for any loss or damage that arises out of or is in any way connected with your use of the Services or with a Booking or use of a Product, then the AEGEANVIP Group Companies’ liabilities will in no event exceed, in the aggregate, the greater of (a) the sum paid to AEGEANVIP in respect of the Booking giving rise to the claim, or (b) Eighty Euros(€80.00).

The limitation of liability set forth in this Section 18 reflects the allocation of risk between the parties. The limitations specified in this Section will survive and apply even if any limited remedy specified in these Terms of Use is found to have failed of its essential purpose. The limitations of liability provided in these Terms of Use inure to the benefit of AEGEANVIP.

Force Majeure: We assume no responsibility for any personal injury, property damage or other loss, accident, delay, inconvenience or irregularity which may be occasioned by reason of any matter beyond our exclusive control including but not limited to a delay or cancellation that causes you to miss all or any portion of the Tour, acts of government, war, terrorist acts, riots, disaster, weather extremes or strikes. We have no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards or climate extremes at locations to which you may travel. You understand6 that health care standards, facilities and services abroad may be different or even inadequate for treating health conditions.

By booking a reservation for a Service through the Website, you acknowledge that you accept the practices described in our Privacy Policy and this Agreement. In addition, you warrant that you are 18 years of age or older, that you possess the legal authority to enter into this Agreement, use this Website, book the Product, and that all information you supply is true and accurate.

Private Tour prices are based on private group booking (a) from 1-10 max persons when an Experience or Service is accomplished using a boat (Yacht, Catamaran, Sailing Boat, Speed Boat, RIB or (b) from 1-5 persons when Tour uses Helicopters or Jets (depending on the capacity of each one).

Certain Services are stated to be subject to instant confirmation. Other than these Services, any required time for confirmation as stated on the Website is solely for reference only. Actual time required for confirmation may vary.

Through this Website, it could be possible to purchase eventual vouchers from AEGEANVIP for the Services (“Vouchers”) offered by the Operators or ourselves. Subject to the policy of the relevant Operator, you will receive an email confirmation of your purchase that will contain a Voucher confirmation number (“Confirmation Number”). In order to use your Voucher, you must appear in person at the meeting point defined by the relevant Operator on time and present it as may be required by the Operator. Failure to appear on time or to provide the required documents or information, no refunds will be granted.

The Tour or Experience cost is either listed on the Website or communicated to you after making a request. The full amount or a deposit is required in order to confirm your booking after you receive our confirmation about the availability of the service requested. In any case after your payment of the full amount or deposit we will send you confirmation of your booking. Your final payment – if any -date will be listed on the confirmation. If a Tour is not available, we will accept deposits on a standby alternative date basis. If alternative date becomes available, you will have the choice of joining the Tour by paying in full or forfeiting the alternative date in return for a refund of your deposit. Final payment is due ninety (90) days prior to departure unless otherwise indicated on the Website or in the brochure. If your reservation is made within ninety (90) days of departure, the entire cost of the tour or experience must be paid at the time of the request in order to secure confirmation.

Is at the whole discretion of AEGEANVIP to apply discounts, and users can benefit from it, related to the official prices of the services created by suppliers or operators. Discount may be apparent as different price than official or may be incorporated to the price without further notifications.

AEGEANVIP is permitted to collect the invoiced amounts in the name of and on behalf of the Supplier. To use the payment functions of AEGEANVIP, the user has to enter correct payment information and update the details immediately in the event of changes. The user will be notified of the payment methods permitted for the respective service during the order process. Upon the authorization of the payment, the user consents to his/her payment8 information being used for the collection of payments by the creditor. AEGEANVIP reserves the right to make the use of the payment function of AEGEANVIP dependent on a check of the credit rating of the user.

Under these Terms of Use, the payment processing services for the Services provided on the Website are provided by ALPHA BANK E-COMMERCE on behalf of AEGEANVIP concerning all major Credit Cards, PAYPAL or by a wire transfer on our bank account.

ALL PAYMENT METHODS

• Direct Bank Transfers (IBAN)
• Pay with Cash or Credit Card at the point of departure if agreed so.

You are responsible for respecting the authority and following the directions of the Tour guide and the laws of the countries in your Itinerary during a Tour. We may exclude you from participating in all or any part of the Tour if, in our sole discretion, your condition or behavior renders you unfit for the Tour or unfit for continuation once the Tour has begun. Unfitness may include, without limitation, any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of Tour services or may constitute a hazard or embarrassment. In such case, our liability shall be strictly limited to refund of the recoverable cost of any unused portion of the Tour. Should you decide for any reason not to participate in certain parts of the Tour or use certain goods included in the Tour, no refunds will be made for those unused parts of the Tour or goods. You agree to indemnify and hold us harmless from and against any costs, damages, losses or liabilities arising out of (a) the actions or omissions of any minors traveling with you and (b) if you checked the box indicating that you are signing on behalf of yourself and your traveling companions, your companions’ claims that you were not authorized to agree to this Agreement on their behalf.

You agree to defend, indemnify and hold harmless AEGEANVIP, its parent or related corporations, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from:

• Your use of and access to the AEGEANVIP Website;
• Your use of the AEGEANVIP Service.
• Your violation of Terms;
• Your violation of any third party right, including without limitation any copyright, property, or privacy right;
• Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our website or local personal tour guides.
• your negligence or willful misconduct.
